Overview

Live Rugged is a brand operated by Rugged Solutions, LLC.

These Terms of Service govern your access to and use of the Live Rugged website, online store, content, features, products, customer accounts, communications, and related services, collectively referred to as the “Services.”

Throughout these Terms:

• “Live Rugged,” “we,” “us,” and “our” refer to Rugged Solutions, LLC.
• “You” and “your” refer to the individual accessing or using the Services.
• “Products” refers to apparel, accessories, merchandise, and other goods offered through the Services.

Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer Products and Services to you. Shopify provides the platform but is not the seller of Live Rugged Products.

By visiting the website, using the Services, creating an account, or placing an order, you agree to these Terms of Service and all policies incorporated into them, including our:

• Privacy Policy
• Shipping Policy
• Returns, Refunds & Exchanges Policy
• Any product-specific terms displayed at the time of purchase

Do not use the Services or place an order when you do not agree to these Terms.

1. Eligibility and Authority

You must be at least the age of majority in your state or jurisdiction to place an order through the Services.

When you permit a minor dependent to browse the website, you remain responsible for their use of the Services.

By using the Services, you represent that:

• You have the legal capacity to enter into an agreement.
• Information you provide is accurate and complete.
• You will use the Services only for lawful purposes.
• You are authorized to use the payment method submitted during checkout.
• You are not prohibited from using the Services under applicable law.

Businesses or organizations using the Services represent that the individual acting for them has authority to bind that business or organization to these Terms.

2. Changes to These Terms

3. Online Store Use

You may use the Services only for personal, lawful, and noncommercial shopping purposes unless Live Rugged gives you written permission for another use.

You may not:

• Use the Services for an unlawful or fraudulent purpose.
• Submit false, misleading, or inaccurate information.
• Attempt to access another customer’s account.
• Interfere with the operation or security of the website.
• Introduce viruses, malicious code, automated attacks, or harmful technology.
• Scrape, copy, harvest, or systematically extract website content or customer information.
• Circumvent purchase limits or store security controls.
• Use bots or automated systems to place orders without authorization.
• Use the Services to infringe another person’s rights.
• Impersonate Live Rugged, Rugged Solutions, LLC, Shopify, another customer, or another person.
• Reproduce or resell Live Rugged artwork or branded merchandise without permission.
• Use Live Rugged intellectual property to produce unauthorized merchandise.

We may suspend or terminate access when we reasonably believe these Terms have been violated.

4. Customer Accounts

Certain features may allow you to create or use a customer account.

You are responsible for:

• Providing accurate account information
• Keeping your login credentials secure
• Restricting unauthorized access to your account
• Updating outdated contact or shipping information
• Activity performed through your account

Contact michael@getruggedtech.com promptly when you believe an account has been accessed without authorization.

We may suspend or close an account when reasonably necessary to:

• Protect the account or store
• Investigate fraud
• Prevent misuse
• Comply with legal obligations
• Enforce these Terms

Customer accounts do not create ownership rights in the Services and may be changed or discontinued where permitted by law.

5. Product Information

We make reasonable efforts to present Products accurately, including their:

• Design
• Color
• Materials
• Fit
• Size
• Weight
• Features
• Images
• Pricing
• Availability

However, product displays may vary depending on:

• Screen settings
• Device type
• Lighting
• Photography
• Manufacturing tolerances
• Garment-washing processes
• Fabric characteristics

We do not guarantee that every color or detail displayed on a screen will exactly match the physical Product.

Descriptions, measurements, photographs, and specifications may be corrected or updated without advance notice.

6. Specialty-Washed and Distressed Products

Certain Live Rugged garments use specialty-washing, fading, distressing, raw-edge, mineral-wash, snow-wash, or similar production processes.

These processes can create natural differences in:

• Color
• Fading
• Texture
• Distressing
• Fraying
• Wash pattern
• Overall appearance

These variations are intentional characteristics of the Product and do not necessarily constitute manufacturing defects.

No two specialty-washed garments are guaranteed to look exactly alike.

Customers should review the individual Product description before ordering.

7. Sizing and Fit

Live Rugged offers different garment silhouettes, including:

• Oversized
• Relaxed
• Fitted
• Cropped
• Boxy
• Unisex
• Women’s-specific cuts

A size designation may fit differently from one Product to another.

You are responsible for reviewing:

• The Product description
• Fit guidance
• Product-specific measurements
• The applicable size chart
• The size and color selected during checkout

General size recommendations are provided for guidance and do not guarantee a particular fit.

You may contact michael@getruggedtech.com for sizing assistance before ordering. Sizing guidance is based on the information you provide and cannot guarantee personal fit or preference.

Returns or exchanges based on sizing, fit preference, color preference, or a selection made during checkout are governed by our Returns, Refunds & Exchanges Policy.

8. Made-to-Order Products

Many Live Rugged Products are produced after an order is placed.

Made-to-order production allows us to offer multiple sizes, colors, graphics, and specialty garments without mass-producing unused inventory.

Because production may begin shortly after an order is submitted:

• Changes cannot be guaranteed.
• Cancellations cannot be guaranteed.
• Size or color exchanges might not be available.
• Orders accurately produced according to the selections submitted during checkout are generally considered final, subject to applicable law and our Returns, Refunds & Exchanges Policy.

Review your order carefully before completing checkout.

9. Prices and Product Availability

Product prices are displayed in United States dollars unless otherwise stated.

We may change prices at any time before an order is accepted.

Price changes do not apply retroactively to completed purchases unless:

• Required by law
• Necessary to correct an obvious pricing error
• Agreed to by the customer

Products may be:

• Added
• Modified
• Discontinued
• Limited by size or color
• Restricted by purchase quantity
• Temporarily unavailable

Placing a Product in your cart does not reserve the Product or guarantee availability.

10. Taxes and Other Charges

Applicable sales tax and other required charges may be calculated during checkout based on factors such as:

• Shipping destination
• Billing information
• Product type
• Applicable tax laws

You are responsible for charges clearly presented and accepted during checkout.

International customers, when international sales are offered, may also be responsible for applicable:

• Import duties
• Customs charges
• Brokerage fees
• Local taxes
• Government assessments

These charges may not be collected by Live Rugged and may be payable directly to a carrier or government authority.

11. Orders and Order Acceptance

Submitting an order is an offer to purchase the selected Products.

An order confirmation acknowledges that we received your order. It does not necessarily mean that the order has been finally accepted or entered production.

We may accept, reject, limit, hold, or cancel an order when reasonably necessary, including when:

• A Product is unavailable.
• Payment cannot be authorized.
• Information appears inaccurate or incomplete.
• Fraud or unauthorized activity is suspected.
• A pricing or Product-description error occurred.
• The order violates a purchase limit.
• The order appears intended for unauthorized resale.
• Fulfillment is unavailable for the delivery location.
• We are legally prohibited from completing the transaction.

When we cancel an order after payment was collected, we will issue an appropriate refund to the original payment method, subject to payment-provider processing times.

We may contact you for additional information before accepting or fulfilling an order.

12. Order Changes and Cancellations

Contact michael@getruggedtech.com immediately when requesting an order change or cancellation.

Include:

• Your order number
• The email address used during checkout
• The requested change

We will make a reasonable effort to assist, but we cannot guarantee a change or cancellation after production begins.

A request is not approved until Live Rugged confirms the change or cancellation by email.

Failure to receive a response before production begins does not automatically cancel the order.

13. Payment

You agree to provide current, complete, and accurate:

• Payment information
• Billing information
• Contact information
• Shipping information

By submitting payment information, you represent that:

• You are authorized to use the payment method.
• The information is accurate.
• You authorize the applicable charges.
• You will pay all charges accepted during checkout.

Payments are processed through Shopify and applicable payment providers.

We may delay, hold, or cancel an order when payment authorization fails or fraud screening identifies a risk requiring review.

Your financial institution or payment provider may impose additional terms or processing times.

14. Promotions and Discount Codes

Promotions, discounts, free-shipping offers, giveaways, and limited releases may be subject to additional conditions displayed with the offer.

Unless otherwise stated:

• Discounts cannot be combined.
• Discount codes have no cash value.
• Discounts cannot be applied retroactively.
• Promotions may be limited by Product, customer, date, or location.
• Promotions may end when inventory or the promotion period expires.
• Shipping charges and taxes may remain applicable.
• We may cancel or correct promotions affected by fraud, misuse, or technical error.

We may modify or discontinue a promotion where permitted by law.

15. Shipping and Delivery

Production and shipping estimates are provided in our Shipping Policy and, where applicable, during checkout.

Delivery dates are estimates rather than guarantees unless expressly stated otherwise.

Delivery may be affected by:

• Production volume
• Carrier delays
• Severe weather
• Holidays
• Incorrect addresses
• Customs processing
• Labor disruptions
• Natural disasters
• Events outside our reasonable control

Products within one order may be produced or shipped separately and may arrive in multiple packages.

Customers are responsible for providing an accurate and complete delivery address.

Shipping, tracking, delayed packages, lost packages, and packages marked delivered are governed by our Shipping Policy.

16. Returns, Refunds, Defects, and Incorrect Items

Returns, refunds, replacements, exchanges, manufacturing defects, shipping damage, misprints, missing items, and incorrect fulfillment are governed by our Returns, Refunds & Exchanges Policy.

Do not mail an item to Live Rugged or a fulfillment provider without receiving authorization and return instructions.

Unauthorized returns may be refused or may not qualify for a refund or replacement.

Nothing in these Terms limits a consumer right that cannot legally be excluded.

17. Care and Use of Products

You are responsible for reviewing and following:

• Product care labels
• Washing instructions
• Drying instructions
• Ironing restrictions
• Product warnings
• Intended-use information

Normal wear, fading, shrinking, damage from improper care, and deterioration caused by misuse are not manufacturing defects.

Printed graphics may be damaged by:

• Excessive heat
• Bleach
• Harsh chemicals
• Improper ironing
• Abrasive washing
• Washing contrary to the care instructions

Live Rugged apparel is ordinary lifestyle apparel unless the Product description expressly states otherwise.

Do not treat a garment as protective, safety-rated, flame-resistant, high-visibility, weatherproof, or performance-certified unless the Product description specifically makes that verified claim.

18. Intellectual Property

The Services and their contents are owned by or licensed to Rugged Solutions, LLC and are protected by applicable intellectual-property laws.

Protected content may include:

• The Live Rugged name
• The Earn Every Scar slogan
• Logos and brand marks
• Product graphics
• Artwork
• Photographs
• Videos
• Product names
• Product descriptions
• Website text
• Layouts
• Designs
• Downloads
• Social-media content
• Promotional materials

Access to the Services does not grant you ownership of or a license to use Live Rugged intellectual property except for ordinary personal use of the website.

Without written permission, you may not:

• Copy or reproduce our artwork
• Produce merchandise using our designs
• Modify or distribute our content
• Use our branding to market another product
• Remove ownership notices
• Create confusingly similar branding
• Use our content for commercial artificial-intelligence training or dataset creation
• Claim affiliation with Live Rugged
• Resell counterfeit or unauthorized Live Rugged merchandise

Purchasing a Product does not transfer ownership of the artwork, trademarks, copyrights, or other intellectual property displayed on it.

19. Customer Reviews, Photos, and Other Submissions

You may be able to submit:

• Product reviews
• Comments
• Photographs
• Videos
• Testimonials
• Feedback
• Suggestions
• Social-media content
• Other materials

You retain any ownership rights you have in your original submission.

By voluntarily submitting content directly to Live Rugged for publication, tagging Live Rugged for potential reposting, or expressly authorizing us to use your content, you grant Rugged Solutions, LLC a nonexclusive, worldwide, royalty-free license to:

• Display
• Reproduce
• Resize
• Format
• Publish
• Repost
• Distribute
• Use the submission to operate and promote Live Rugged

This license applies only to the extent reasonably connected to the permission you provide and subject to applicable law.

You represent that:

• You own or have permission to submit the content.
• The content does not infringe another person’s rights.
• Any people shown have authorized the submission where required.
• The content is accurate and not misleading.
• The content does not contain unlawful, threatening, hateful, obscene, defamatory, or malicious material.

We may moderate, reject, hide, or remove submissions where permitted by law.

Do not submit confidential information, trade secrets, or ideas that you expect us to keep confidential without a separate written agreement.

20. Feedback and Product Ideas

When you voluntarily submit general comments, suggestions, or feedback about the existing store or Products, we may use that feedback without an obligation to compensate you.

This section does not transfer ownership of a separately developed invention or confidential concept submitted under a written confidentiality agreement.

Do not submit confidential inventions, proprietary product designs, patentable concepts, or trade secrets through ordinary customer-service channels.

21. Third-Party Services and Links

The Services may include links to or integrations with third-party websites, payment providers, social-media services, shipping carriers, apps, and other platforms.

Third-party services are governed by their own:

• Terms
• Privacy policies
• Security practices
• Availability
• Customer-support procedures

Live Rugged does not control and is not responsible for third-party content, policies, or services except to the extent required by law.

Review third-party terms before using those services.

22. Shopify

The online store is hosted through Shopify.

Your use of store features may involve Shopify processing information and providing technology necessary to:

• Display the store
• Operate checkout
• Process orders
• Support customer accounts
• Provide fraud prevention
• Facilitate payment and fulfillment services
• Improve Shopify-hosted services

Your personal information is handled as explained in our Privacy Policy and applicable Shopify privacy notices.

23. Privacy

Our collection, use, processing, retention, and disclosure of personal information are governed by our Privacy Policy.

By using the Services, you acknowledge the data practices described in that policy.

Shopify recommends informing customers in store terms and privacy disclosures that Shopify hosts the store and processes customer information in connection with its platform and enhanced services.

24. Errors, Inaccuracies, and Omissions

The Services may occasionally contain errors involving:

• Product descriptions
• Pricing
• Promotions
• Availability
• Shipping charges
• Delivery estimates
• Measurements
• Images
• Website content

We may correct errors, update information, or cancel an affected order where reasonably necessary and permitted by law.

When an error materially affects an accepted order, we may contact you before proceeding or provide an appropriate refund when the order cannot be completed as represented.

25. Service Availability

We do not guarantee that the Services will always be:

• Available
• Uninterrupted
• Error-free
• Secure
• Compatible with every device
• Free from technical problems

We may modify, suspend, or discontinue all or part of the Services for:

• Maintenance
• Security
• Legal compliance
• Technology changes
• Business reasons
• Events outside our control

Where reasonably practical, we may provide notice of a material permanent change.

26. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Services are provided on an “as available” and “as is” basis.

Except for express statements made in a Product description or rights that cannot legally be excluded, Live Rugged disclaims implied warranties, including implied warranties of:

• Merchantability
• Fitness for a particular purpose
• Title
• Non-infringement

We do not warrant that:

• The website will be uninterrupted or error-free.
• Every display will perfectly reproduce a Product’s color.
• The Services will meet every personal preference.
• User-generated content will be accurate.
• Third-party services will remain available.

This section does not exclude express Product obligations, approved defect claims, or mandatory consumer rights.

27. Limitation of Liability

To the fullest extent permitted by law, Rugged Solutions, LLC and its owners, employees, contractors, service providers, and representatives will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or connected with the Services.

This may include loss of:

• Profits
• Revenue
• Data
• Business opportunity
• Goodwill
• Use
• Expected savings

To the fullest extent permitted by law, our aggregate liability arising from a specific order will not exceed the amount you paid to Live Rugged for the Product or order giving rise to the claim.

These limitations do not apply where liability cannot legally be limited or excluded, including where applicable to:

• Fraud
• Willful misconduct
• Gross negligence
• Personal injury caused by legally actionable conduct
• Mandatory consumer-protection rights

Some jurisdictions do not permit certain exclusions or limitations. In those jurisdictions, the limitation applies only to the maximum extent permitted.

28. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Rugged Solutions, LLC and its owners, employees, contractors, representatives, and service providers from third-party claims arising from:

• Your unlawful use of the Services
• Your material violation of these Terms
• Your infringement of another person’s rights
• Content you submit
• Fraudulent or malicious activity performed through your account

This obligation does not apply to the extent a claim results from Live Rugged’s own negligence, unlawful conduct, or breach of these Terms.

29. Force Majeure

Live Rugged is not responsible for delay or failure caused by circumstances beyond its reasonable control, including:

• Natural disasters
• Severe weather
• Fire
• Flood
• War
• Civil unrest
• Terrorism
• Government action
• Public-health emergencies
• Labor disputes
• Carrier disruptions
• Internet or utility outages
• Supplier interruption
• Fulfillment disruption
• Cyberattacks
• Customs delays

This section does not eliminate obligations that cannot legally be excluded, including applicable refund or delivery obligations.

30. Termination

These Terms remain effective while you use the Services.

You may stop using the Services at any time.

We may suspend or terminate your access when reasonably necessary because of:

• A material violation of these Terms
• Fraud or suspected fraud
• Abuse of the Services
• Security risk
• Unlawful conduct
• Legal requirements

Termination does not eliminate obligations or liabilities that arose before termination.

Sections intended by their nature to continue after termination remain in effect, including provisions concerning intellectual property, payment obligations, liability, indemnification, and dispute resolution.

31. Severability

When a provision of these Terms is determined to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted or modified only as necessary.

The remaining provisions will continue in effect.

32. No Waiver

Failure to enforce a provision of these Terms does not waive the right to enforce it later.

A waiver is effective only when made in writing by an authorized representative of Rugged Solutions, LLC.

33. Assignment

You may not assign or transfer your rights or obligations under these Terms without our written consent.

We may assign or transfer these Terms as part of:

• A merger
• Acquisition
• Sale of assets
• Financing
• Reorganization
• Transfer of the Live Rugged business

Any assignment remains subject to applicable law.

34. Entire Agreement

These Terms and the policies incorporated into them constitute the complete agreement between you and Live Rugged concerning your use of the Services and purchase of Products.

They replace prior or contemporaneous communications concerning the same subject, except for a separate written agreement signed by an authorized representative of Rugged Solutions, LLC.

Headings are included for convenience and do not change the meaning of a provision.

35. Governing Law and Disputes

These Terms and transactions with Live Rugged are governed by the laws of the State of Utah and applicable federal law, without regard to conflict-of-law principles.

Subject to mandatory consumer rights and any law requiring a different location, legal proceedings concerning these Terms or the Services may be brought in the state or federal courts serving Davis County, Utah.

Nothing in this section prevents either party from:

• Bringing an eligible matter in small-claims court
• Seeking emergency injunctive relief
• Exercising a consumer right that cannot legally be waived
• Filing a complaint with an appropriate government agency
